Captured fugitives get 8 years jail, whipping for robbery, escaping police custody


Two men who escaped from police custody and were on the run for two years, were today sentenced to eight years jail each and whipping after they pleaded guilty to committing multiple offences, including gang robbery and fleeing from the cops.Hamzani Harun, 38, and Hissham Abdul Rahman, 40, pleaded guilty at the Butterworth Sessions Court to robbing Tann Suu Ee, 29, of 14 branded computers and RM1,000 cash on July 26, 2012 about 5.20am in Tasek Gelugor.They had committed the robbery while armed with machetes, an offence under Sections 395 and 397 of the Penal Code, with another person who is still at large.Sessions judge Meor Sulaiman Ahmad Tarmizi sentenced the duo to six years jail each and two strokes of the rotan.The duo, who were unrepresented, appealed to the court to let them serve their sentences concurrently, since they were facing multiple charges.But their request was denied after Deputy Public Prosecutor Fauziah Daud asked the court to order the duo to serve their sentences consecutively because they were not sorry for the crimes they committed.At a Butterworth Magistrate's Court later, Hamzani and Hissham were charged under Section 224 of the Penal Code for escaping police custody.They pleaded guilty to the offence, which was committed with five others on January 7, 2013 at about 9.45am at Butterworth Outer Ring Road interchange in Bagan Ajam while they were being transported from the Penang Prison to the court to be charged.Magistrate Muhammad Firdaus Abdul Wahab sentenced the men to 20 months jail each. They will serve the sentence after completing their six-year term for armed gang robbery.Hamzani and Hissham were then charged under Section 28 (i)(ii) of the Minor Offences Act, read together with Section 34 of the Penal Code, for possessing tools and weapons, such as nine pliers, six screwdrivers, a hammer, a saw and four machetes, that were used in their armed gang robbery in July 2012.They also pleaded guilty before Firdaus sentenced them to four months jail each.Hamzani and Hissham also pleaded guilty to injecting morphine into their own bodies on January 21 this year at about 6pm at the district narcotics office, an offence under Section (1)(a) of the Dangerous Drugs Act.The duo face a maximum two years jail or up to RM5,000 fine for the offence but Firdaus deferred the sentencing until March 26 pending the pathology reports.Hamzani and Hissham, however, claimed trial when charged with hurting civil servants, Mohd Nazzwuan Md Zain, Mohd Azizan Ahmad, Muhammad Sharifuddin Ali and T.Mahendren, who were escorting them from prison to the court in Butterworth on January 7 two years ago when they escaped.Firdaus set March 26 for trial. Deputy Public Prosecutor Mohd Khairul Fairuz Rahman prosecuted at the Magistrate's Court.Hamzani and Hissham’s two-year run ended last week when they were nabbed by the police in Jitra, Kedah.It was reported that curry or chilli powder was thrown at the policemen, who were then overpowered, in the police van during the escape. The seven fugitives then disappeared into an oil palm plantation in Tasek Gelugor and went their separate ways.The police launched an extensive manhunt around the mainland and in nearby Kedah. A few days after the escape, police shot dead two of them - Mohd Fairuz Adam, 31, and Mohd Noor Mustafa, 28 - who resisted arrest and fired at the cops in Kampung Padang Ibu in Penanti, Permatang Pauh.Mohamad Farid Akhtar, 24, and Mohd Shahrimi Mohd Noor, 28, later turned themselves in while Mohamad Khairulnizam Abdul Rani, 26, was nabbed at an Internet cafe in Bukit Mertajam.In March 2013, the trio were sentenced to two years jail each after they pleaded guilty at the Butterworth Magistrate's Court to four charges of injuring the four police escorts during their escape.They were also sentenced to another 18 months' jail each for escaping from police custody. The two sentences were to be served concurrently. – January 28, 2015.
